The U.S. Marshals Service knows the suspect in a Des Moines rape case
is in Africa and it is working to have him returned to Iowa to faces
charges that he impregnated a severely disabled woman entrusted to his
care.
It was one year ago today that Napoleon Mbonyunkiza, now 42, failed to
show up for a court hearing in Des Moines.
He is charged with third-degree sexual assault, neglect of a dependent
adult, and dependent adult abuse, as well as skipping out on his court
appearance.
Mike Powell, supervisory deputy with the U.S. Marshals Service in Des
Moines, said Friday that Mbonyunkiza is in Uganda.
He said that Uganda and the United States do not have an extradition
treaty but that officials in Uganda are being cooperative. Officials
in both countries are in negotiations for Mbonyunkiza's return.
He was released from jail in Des Moines on $30,000 bond in May 2010
and was to have reported to the Polk County Courthouse at 8 a.m. on
June 4, 2010.
District Judge Odell McGhee waited until 8:35 a.m. and then declared
that Mbonyunkiza failed to appear. Bond was set at $100,000.
Police were sent to Mbonyunkiza's residence in the 3300 block of
Valdez Court in Des Moines the day before his court date to take a
missing-persons report.
His daughter said her father was not there when she returned from
school on June 2, 2010.
A police report filed at the time said, "Napoleon and his wife have
not been talking for some time."
Mbonyunkiza pleaded guilty in 2009 of interference with official acts
after he fought police officers who tried to arrest him on a domestic
abuse charge. Officers used a stun gun to take him into custody.
He was working at a group home when he was accused of sexual assault.
Police said he impregnated a 33-year-old woman with cerebral palsy who
cannot speak or communicate.
The pregnancy was terminated. Police said the woman has a history of
seizures, mental retardation and has difficulty tolerating the touch
of others.
The pregnancy was discovered during a medical exam. About 25 group
home workers submitted DNA samples. Officials said Mbonyunkiza's DNA
was a match.
He is from Rwanda and apparently left the Des Moines area with about
$2,000 in cash.
At last report, police were trying to determine whether Mbonyunkiza
was responsible for other similar crimes in the Polk County area.
